ANSWERS are being demanded after court officials said they had no records of a two-day hearing which happened in January.

Fran Budd, of Cattlegate Road, Crews Hill, went to court against Warmerdam Garden Centre over boundary fencing, claiming they had encroached onto her property, with the case being heard at the Royal Courts of Justice (RCJ) between January 25 and 26.

At the time, the presiding justice, Judge Faber, decided to postpone a decision for three months in order to look over all the evidence in the case.

However, when the court was contacted recently to ask if a decision had been made, they said there was no record of any trial and the matter had been resolved.

Ms Budd said: “It is the phantom trial. We were told it never happened, which must mean everyone involved were on some pretty strong hallucinogenic drugs to have dreamt it all up together.

“I have complained to everyone, to the justice secretary, to the courts, but have not got anywhere. It is astonishing, I have never heard of anything like this before."

In a letter from Kevin Morgan of Carbon Law Partners, who represented Ms Budd in the case, it was revealed that the RCJ had claimed the matter had been settled out of court in December 2015, and had no notes on the two-day hearing.

It said: “Some disturbing news from the Court. We could not get them to accept that the trial did go ahead and that we are waiting for judgment.

“We agreed that we would both let our barristers know as often they or their clerks, who are based in London, will have personal contacts at the Court who can make some sense of this, or even the Judge.

“Obviously the Court’s position is outrageous, and if you want to contact them then please go ahead. It may even be that a call from a disgruntled party might stir them into some action, as clearly they are not accepting the solicitors’ position.”

Barristers from both Ms Budd and Warmadam have written a letter to Judge Faber, seen by the Enfield Independent, which indicates not only did the trial take, but the judge had visited the site in dispute, Ms Budd’s back garden.

According to Ms Budd, as of yet there is no current notice of when the judgement will take place.

The RCJ have been contacted for comment.
